Mountain division court martial sitting at Muhoti Barracks in Fort portal has sentenced Pte. Lokutei Paul to 90 years imprisonment after proving him guilty of two counts of murder, contrary to sub section 188 of the penal cord act chapter 120.
Court heard that on 30th October 2020 at around 8:00pm the convicted officer 36 unlawfully, intentionally and with malice shot and killed Nayebare Pamela 26 and her infant son Kusemererwa Owen (09 months).
It also heard that the incident happened after the two developed an argument over a mobile phone in a bar at Kitumba village, Nyakigumba town council, Bunyangabu district.
Despite the accused pleading not guilty to the offences, prosecution guided by mountain division legal officer and judge advocate Capt. Ivan Nabireeba produced all the evidence to prove him guilty beyond reasonable doubt.
Defense lawyer Lt George W Kabanda requested court for a lenient sentence to his client since he is a first time offender and has a big family of five wives and 18 children and since it was not his intention to kill because he was provoked when he was under the influence of alcohol.
While passing the sentence, court chairman Lt Col Feliz Nyero said that basing on the gravity of the offence committed and the evidence produced by prosecution, the sentence is appropriate and this should serve as a lesson to others that UPDF has zero tolerance to criminality.
The court chairman however advised the convict to appeal against the ruling within 14 days in case he is not satisfied with the judgment.
