By YosamGucwaki
In Masindi–
Chrispus Ayena Odongo; the lawyer representing Bunyoro Kitara
Reparations Agency (BUKITAREPA), has blasted judicial officials who described the order granted to BUKITAREPA by Masindi High court as
fake.
Last week Masindi High court being presided over by the Registrar entered a default judgment against the seven district land boards of
Bunyoro sub region.
BUKITAREPA dragged the seven Bunyoro land boards in to court
accusing them of issuing titles of the land they have never owned.
BUKITARPEA through their lawyer Ayena OdongoChrispus applied for a
permanent injunction against the seven land boards restraining them
from issuing land titles.
Among other things the petitioners demanded was the cancellation of
land titles issued since 1998 when the district land boards wereconstituted.
However, AcioJulia, delivered a default judgment in the case after the respondents failed to file their defense.
Yesterday it was published in news papers that an order which
was issued by the Registrar Masindi High court Acio Julia that it was fake something that has drawn angry reactions from their BUKITAREPA’s lawyer and its chief coordinator Doviko Batwale.
Ayena, added that BUKITAREPA sued the seven district land boards but
they decided not to appear in court adding that as far as they know the law, where there is no contest about the case that has been filed in
court, the law authorizes the Registrar to enter judgment.
He added that if some Judicial officials can rubbish this, it appears
that even within the judicial circles itself there are people who are
not aware of some provisions in the law. Ayena also said that they have seen a letter from the chief Registrar over this matter noting that he cannot overturn a judicial decision without going through the due
process adding that the chief registrar has a right to know explaining that that is why he has called for a file to see what could have transpired exactly.
