KABALE UNIVERSITY STUDENTS CASE AGAINST RDC,DPC FAILS TO KICK OFF

The hearing of a case in which the Kabale Deputy RDC, Denis Nzeirwe and the Kabale District Police Commander ;Dickens Bindeeba are accused of assaulting a former Kabale University student yesterday failed to kick off after the chief Magistrate and the accused failed show up.

Nzeirwe and Bindeba are facing charges of assaulting Nicholas Byonanabye, who was then a third year Information Technology student at Kabale university, accusing him of spearheading the students’ strike on 14^th October 2016 while at the gate of Kabale district head offices in Kabale Municipality.

The suspects were expected to appear before the Kabale Chief Magistrate’s court last morning but did not take place as the presiding magistrate and the accused persons did not show up. But Nzeirwe was represented by Rachel Lubowa a State Attorney at Ministry of Justice and Constitutional Affairs.

The Kabale grade one magistrate Raphuel Vueni adjourned the case to 11th January 2018 as his court had no jurisdiction to hear the case. He also revealed that the Kabale chief Magistrate Moses Ntende Kagoda was transferred and they will wait for new chief magistrate.

However, the pleader for Byonanabye, Eron Kiiza of Niwagaba and Mwebesa Advocates said that despite the suspects not turning up, they are ready to come on given date for the hearing so that justice can prevail.
