IBANDA CHIEF MAGISTRATE REJECTS MAJ. GUMA’S VOTE RECOUNT APPLICATION

Ibanda Chief Magistrate Moses Kagoda on Monday rejected the
application for Vote re-count for Ibanda North constituency.
The application was filled by Maj. David Guma Gumisiriza, a former contestant on Independent ticket who was defeated by Xavier Akampurira Kyoma in the recent concluded parliamentary elections.
In the application which was filed to the Electoral Commission Maj. Guma complained that declaration forms obtained had many mistakes, irregularities and forgeries which he pointed and insisted for a vote recount.
Xavier Akampurira Kyoma (NRM) got 13,513 votes while Maj. David Guma Gumisiriza (Independent) got 13,186 votes.
According to documents handed to court by Maj. Guma Gumisiriza, he requested for Vote re-count in Ibanda South constituency instead of Ibanda North where he contested with Kyoma, Ssemakura and Gilbert Mugisha Karengye.
This mistake gave Kyoma’s Lawyer led by his counsel Bonafance Ngaruye Ruhindi of Ngaruye and company of advocates an upper hand to request the Court to quash the application.
While giving his ruling, the Chief Magistrate Moses Kagoda stated that the applicant Maj. Guma Gumisiriza did a big mistake to request for vote re-count in Ibanda South Constituency where he didn’t contest instead of vote recount in Ibanda North constituency where he had contested.
Kagoda said Court could not waste time and resources on a futile
activity of a vote re-count.
