COURT MARTIAL SETS BOBI WINE FREE; MAGISTRATES COURT CHARGES HIM WITH TREASON

Kyadondo East MP Robert Kyagulanyi, aka Bobi Wine, has been re-arrested by the police shortly after the army court acquitted him of charges of being in possession of guns and ammunition.
Bobi Wine was later taken to the Gulu Chief Magistrate’s Court where he was charged with treason.
Gulu Chief Magistrates Court has Thursday charged Kyadondo East MP Robert Kyagulanyi (Bobi Wine) with Treason contrary to Section 23 of the Penal Code Act.
According to the amended charge sheet, the MP was charged along with 34 others including fellow MPs with offices related to alleged attempt to harm President Yoweri Museveni, during a campaign rally chaos in Arua district.
The prosecution claims that these, with intent to do harm to the person of President Yoweri Museveni, unlawfully aimed and threw stones, hitting and smashing the rear windscreen of the presidential car.
The Chief Magistrate told Hon Bobi Wine before remanding him, that the offices against him were capital in nature and the court has no jurisdiction over them
Bobi Wine’s lawyers led by Counsel Lubega Segonna did not object to remanding their client, but asked that he should be remanded to a Hospital, given his physical and mental status.
Segona told court that the MP had been “beaten and brutalised by the military”
“We ask that he is remanded in in a private hospital. We do not object to him being guarded there by the Prison authorities,” he said.
The state on the other hand, argued that Bobi Wine’s health could be easily managed in Gulu Main Prison.
But in his ruling, the Magistrate ordered that the accused person be remanded in a health facility, saying that the court could not by any means overlook the health condition of Mr Bobi Wine.
“I have taken a look at the accused person and, this court being a custodian of justice can sit back as his health is deteriorating.”
The magistrate said Bobi Wine, along with other suspects alleged to be in poor health, should be allowed access to their private doctors and those that cannot afford them, should be taken to health facilities and treated.
The case was adjourned to 30th August.
