Masindi high court has today sentenced a 34 year old man to 12 years in prison for defiling a 13 year old girl in Karungu Village in Kiryandongo sub county.
Atherton Kunkundakwe, the Resident state attorney told court that Francis Ojok, who was a guardian to the victim, performed a sexual intercourse with her in 2012.
He added that as a result of the act the victim became pregnant and gave birth by caesarian section to a baby girl. Francis Ojok pleaded guilty before court.
Harriet Ajok, the counsel representing the accused asked court to award a lighter sentence to Ojok since he never wasted court’s time by pleading guilty and being his first time to perform such an act.
Awarding the sentence to Ojok, Wilson Musale Musene, the Masindi high court visiting Judge stated that the case calls for a deterrent sentence to discourage other people from involving themselves in such acts adding that cases of aggravated defilement are rampant in Bunyoro sub region.
He also considered the victim producing by caesarian section, producing at the age of 13 and the accused being guardian to the victim.
Musene noted that the guardian was supposed to protect the victim but not to indulge her in sexual acts.
Musene also explained that the accused would have been given a sentence of over 20 years but since he pleaded guilty, court had to reduce it to 12 years. The judge also considered the 7 years Ojok had spent on remand.
