HE PICKED LOVE MESSAGES FROM LOVE SONGS TO SEND TO RWABWOGO—ISIKO’S LAWYER

Hearing of an appeal challenging a two-year jail sentence for a 25 year old Student convicted of cyber harassment and offensive communication against the Kabarole District Woman MP Sylvia Rwabwoogo, has started today.
Brian Isiko, 25, had been sentenced to two years in Luzira Prison but applied for bail which was granted last month by Justice Jane Francis Abodo after presenting two substantial sureties and being a first time offender.
Isiko was in July this year convicted by Buganda Road Magistrate’s court after confessing his too much love for Ms Rwabwogo. However, he appealed against the same in the High Court.
In his appeal, Isiko, a student of YMCA-Jinja branch argues that the sentencing magistrate erred when she changed his plea of not guilty to a plea of guilty based on partial admission.
Isiko’s lawyer reproduced the record of the lower court where he admitted downloading MP Rwabwogo’s contact from the parliamentary website and expressed his freedom of speech through sending her love messages that he had picked from love songs and poems of American celebrities including Don Williams and Enrique Iglesias.
“There is no single love message or phone call that is rude, obscene or indecent tendered in court by MP Rwabogo as originating from Isiko. The magistrate therefore acted unreasonable to convict him of offensive communication,” Wasiwa told court.
He further argues that the magistrate erred when she convicted him without subjecting the sntite evidence of the complainant to the standard required in a criminal trial.
