KABALE CONTRACTOR THREATENS TO SUE MUNICIPAL OVER BREACH OF CONTRACT

Danson Mujuni, the contractor hired to collect street parking fees in Kabale town Kabale Municipality has threatened to sue the municipal for breach of contract.
In his letter dated 13th February 2019, the suit filed by his lawyers Collins Agaba of Ngaruye Ruhindi Spencer and company advocates challenges the circumstances under which the municipal authorities breached his contract which was supposed to run up to the end of 2019.
Mujuni is demanding for 179,450,000 million shillings as special damages, 100,000,000 million shillings as general damages and 10,000,000 million shillings as costs of the suit.
In 2018, Kabale Municipal council contracted Mujuni to collect parking fees on Kabale Main Street, Kigongi Street, Keita road, Nkunda road,Nyerere Street and Nyerere Avenue.
Mujuni was expected to charge each vehicle 300 shillings per hour. He was also expected to remit 750,000 shillings to the municipal council every two weeks.
However, on 23rd December 2018, the municipality authorities led by the Kabale Municipality Mayor Emmanuel Sentaro Byamugisha suspended Mujuni from collecting parking fees accusing him of failing to abide by the contract terms.
Municipal authorities also alerted police to arrest anybody found collecting street parking fees.
Mujuni was also accused of charging motorists 250,000 shillings for wrong parking instead of the agreed 20.000 shillings.
However Mujuni argues that the suspension of the contract is illegal.
“The municipal authorities haven’t followed the rightful procedure in terminating my contract, they must refund my money or else we take another action,” Mujuni laments.
The Kabale Municipality Town Clerk Joseph Monday says that they have received the letter and that they have already started compiling defense.
