High court in Kabale has finally given its final verdict in an election petition challenging victory of Security minister Maj. Gen. Jim Muhwezi Katugugu in the Rujumbura County.
Fred Tumuheirwe Turyamuhweza the Former county MP ran to court to challenge the victory of his opponent and winner of January parliamentary election claiming that the election was not conducted in accordance with the provisions and principles laid down in electoral laws.
The Electoral Commission declared Gen Muhwezi as the winner of the January 14 polls with 23,990 votes while the petitioner polled 20,556 votes.
However, the presiding Judge, Justice Phillip Odoki today dismissed the petition with costs.
“Since the petitioner has failed to prove to the satisfaction of the petition, the petition is accordingly dismissed with costs,” read the email from high court.
Gen. Muhwezi was being represented by former deputy Attorney General Mwesigwa Rukutana of Mwesigwa Rukutana & Co. Advocates.
This is Rukutana’s first election petition to handle ever since he was dropped from Cabinet mid this year and returned to private practice after 28 years.
