KATERERA COUNTY BLOOD BROTHERS: MBARARA HIGH COURT SORTS OUT THEIR LONG TERM ELECTION CONFLICTS, MUHAMMED KATO MANTAINED WINNER

High court in Mbarara led by Moses Kazibwe Kawumi has dismissed an election petition challenging the victory of Muhammed Kato as Member of Parliament for Katerera County constituency in Rubirizi District.
The former Member of Parliament for Katerera County Hatwib Katoto filed the election petition in court seeking for nullification of Kato’s victory and being declared the winner or court compels the Electoral commission to organize fresh elections.
The petition also had the electoral commission as the second respondent.
The Katoto through his lawyer Abubaker Ssekajako gave a number of grounds that included lack of requisite academic qualifications for Kato to contest as a Member of Parliament.
He also told the court that the election was not conducted in accordance with the principles laid down in the provisions of the constitution.
However, Muhammed Kato the 1st respondent through his counsel Obed Mwebesa objected to the petition contending that the affidavit accompanying the petition was commissioned by a commissioner for oaths whose practicing License had expired when he commissioned the affidavit.
Acting deputy registrar Samuel Twakire, who read the judgment on behalf of Justice Moses Kazibwe Kawumi dismissed the petition on ground that it was not supported with a valid affidavit.
He dismissed the petition with costs to both counsels of the respondents.
