The Kisoro Chief Magistrate court led by his worship Komakech Keneth has sentenced a 31-year-old man to four years in prison and three million shillings fine for intentionally removing a left eye of a 13-year-old by stoning.
The convict is Tushabe Joram, a resident of Nyabaremura Cell, Rubuguri town council in Bukimbiri County while the Victim is Gumisiriza Denis of the same residence and a primary five pupil at Rubuguri primary school.
While appearing for the first court hearing on 5th April 2023, Tushabe pleaded guilty of doing an act intended to cause grievance harm.
Court records indicate that on 31st January, Tushabe hit Gumisiriza’s left eye with intention to disable it. The eye was injured and removed, losing sight thereafter.
Speaking to voice of Muhabura, the Victim’s father Byaruhanga Nyasiyo commended Owebeyi James, a professional lawyer and former aspirant for the Bukimbiri constituency parliamentary seat for leading his son to justice.
Byaruhanga noted that he had not opted for legal actions because he was financially handicapped but Owebeyi used his own resources and time to fight for justice for his son, adding that only God will reward him.
He also says that his son is living with much pain, especially routine headaches during the nights, a major challenge to him.
Owebeyi James applauded the court for making a timely ruling saying that the violence done on the juvenile was unusual.
He also noted that his next step will be taking the boy to a better hospital where they can fix an artificial eye into him.
Meanwhile he says that he has plans of instituting a law firm in Kisoro district so that he continues advocating for the less privileged.
