MAGISTRATE GIVES LAST ADJOURNMENT TO COL BESIGYE’S KABALE CASE

IN KABALE—
Chief magistrate’s court in Kabale district has given one last chance to
state to produce all the witnesses in the case in which For God and My
Country Leaders (4GC) are accused of inciting violence.
The opposition leaders include; former Forum for Democratic change FDC
presidential candidate, Col. Dr. Kizza Besigye, the Kampala Lord Mayor
Erias Lukwago, Member of Parliament Kawempe Division South Mubaraka
Munyagwa, FDC secretary for mobilization Ms Igrid Turinawe, Rukungiri
municipality MP Roland Mugume Kaginda and Democratic Party’s Imam
Makumbi.
The opposition leaders are facing charges of inciting the public on
14th July 2012 at Kabale stadium where four policemen were injured and
four police cars vandalized by their stone pelting supporters.
The prosecution led by senior state attorney Gloria Inzikuru asked for
an adjournment to allow state produce more two witnesses since the
Kampala lord Mayor Erias Lukwago was not in court. The witnesses are
Florence Nyirabana and Badru Ssemwanga Rutaya.
However the defense lawyers Julius Galisonga and Justus Muhangi of
Muhangi and company advocates objected saying that when the case was
adjourned to date, the state promised to produce all the witnesses.
They also added that it is uncalled for, for state to claim that
Lukwago was not in court yet under constitution 28(5) allows court to
hear the case provided the accused has consented.
His worship Moses Ntende Kagoda who presided over the case said that they are giving benefit of doubt to state
to produce all witnesses. He adjourned the cases to 12th January 2017.

Shortly after court, Dr. Kizza Besigye told the press that the case
has been kept pending in an effort to harass the opposition. He added
as people fighting for their rights, they will fight until they
reclaim their victory.
