MAN SENTENCED TO 11 YEARS AFTER PLEADING GUILTY OF FORCED DEFILEMENT IN RUKUNGIRI

High court in Rukungiri has sentenced a man aged 24, Daniel Mbonigaba of Kataburaza cell, Rutendere Parish, Kayonza Sub County in Kanungu district to 11 years in prison after he pleaded guilty of aggravated defilement on Tuesday.
The high court session was presided over by Justice Moses Kazibwe Kawumi.
Prosecution lead by state attorney, David Katungyi told court that Mbonigaba on 16th April 2017 wooed 10 years old minor with a bottle of soda and defiled her in his house; the victim did not bear the pain he got which forced her to inform her parents who reported the case to police.
Mbonigaba pleaded guilty of the offence saying he was betrayed by his mind that told him that the girl was old enough to have affair with her.
“My lord, it’s true I made a program with the victim to visit me at around 4:30pm when she found me in my shop where I had affair with her. My lord I ask this court to consider two year I have been on remand and forgive me so that when I go home I get married to a mature girl and settle,” he pleaded.
State attorney, David Katungyi said the convict had no previous criminal record and the fact that he did not waste court time, but the act of men defiling young girls is becoming rampant in Kanungu and Rukungiri.
“I ask this court to give him a heavy punishment like 30 years in prison so that young girls can get time to grow old as well as enjoying their education and this can deter other men from using babies as wives when old women are looking for men in vain” he submitted.
Defense lawyer, Jonathan Bwagi asked court to be lenient in giving the convict punishment since he looked as reformed person who would go and form the family and considering the fact that he did not waste court’s time.
Justice Moses Kazibwe Kawumi while delivering the judgment said he has considered the time the convict has taken on remand and the fact that he pleaded guilty of an offence he sentenced him to 11 years in prison minus the two he has been on remain and will only serve 9 years.
The same court acquitted two people Moses Rugasira and David Twongeirwe both from Katete in Kanungu of murder charges after prosecution failed to produce evidence pinning them on murder charges.
“I put a blame to the prosecution for detaining you for all this time without enough evidence that you were in any way involved in this alleged murder case, I therefore acquit you according go home and unite with your families again,” he ruled.
