MASINDI RDC, MAYOR DRAGGED TO COURT FOR MALICIOUS DAMAGE

Masindi district based tycoon also former Bunyoro Kitara kingdom minister, Oscar Baitwa has sued the Masindi Resident District Commissioner, Godfrey Nyakahuma, the mayor of Masindi municipality, Joab Businge and three others to Masindi court.
The charge sheet dated 27 this month signed by the Chief Magistrate, Kintu Zirintusa and seen by our reporter indicates that Nyakahuma and four others are charged with malicious damage and misuse of office.
Others sued include the municipal enforcement officer, Ausi Kunanuka, the Nyangahya Division LC 3 chairperson, Judith Byarugaba and the Nyangahya Division Town Clerk, Isabel Ndahura.
According to the charge sheet, on April 30 this year at Ihungu, Kiryanga ward, Nyangahya Division in Masindi municipality, the five, mobilized a group of men who vandalised, uprooted poles and caused damage to the fence situated on the land belonging to Baitwa.
When contacted on phone, Baitwa confirmed the suit and said the accused went beyond their limits and uprooted poles he planted on his Ihungu land in Masindi municipality without a court order.
Baitwa claimed that the Ihungu land was given to him by the Omukama of Bunyoro-Kitara Kingdom, Dr Solomon Gafabusa Iguru. As such, he says that he is the rightful owner of the land since he allegedly possesses its title.
Baitwa said that the constitution of Uganda did not restore kingdoms but kings.
According to the charge sheet, the five are supposed to appear before the court on 4th next month at Masindi magistrate’s court.
When contacted on phone, the mayor of Masindi municipality Joab Businge, said he had not yet received the summon.
Also when contacted, the Masindi RDC, Godfrey Nyakahuma said he could not comment on the matter.
