MBARARA ARRESTED DISTRICT OFFICIALS SUE ANTI CORRUPTION UNIT

The newly appointed State House Anti corruption unit together with its head Lt. Col. Edith Nakalema have been dragged to High Court civil division for usurping the powers of the IGG.
Lt. Col. Nakalema and her anti corruption unit is being sued by five people including Felix Cuthbert Esoku; the CAO of Mbarara district.
Esoku is one of the people who have so far been arrested by Lt. Col. Nakalema and charged before the Anti corruption court for offenses of unlawful allocation of Government land.
The group accuse Nakalema’s committee of over stepping its mandate which is merely receiving corruption related complaints and forwarding them to the concerned organs such as the IGG that is vested with powers to handle corruption related cases.
They also challenge the actions of the Anti-corruption unit and Lt. Col. Nakalema of taking on corruption cases which are already a subject of investigation by the IGG and ordering police to arrest and detain suspects for more than the mandatory 48hrs without producing them in court for formal charging.
To them this breaches the rules of natural justice as the Unit conducts investigations, carries out arrests, prosecutes suspects and becomes judges in their own case.
The five complainants who are all Mbarara district senior officials now demand that Lt. Col. Nakalema pays each of them 300 million shillings as compensation for their violated rights contending that she had no authority to storm their offices and arrest them on the 22nd February 2019 or later cause their charging before the Anti- corruption court last week.
The officials contend that as public servants they are not accountable to the State House Anti-corruption unit and hence forth their recent charging before the Anti-corruption court is unlawful and they should be discharged.
Justice Musa Sekaana has fixed this case for hearing on Wednesday this week.
