MBARARA COURT DISMISSES KAMURARI’S ELECTION PETITION WITH COSTS

Mbarara high Court judge his lordship Moses Kawumi has today dismissed with costs the election petition 002 /2021 filed by Jeremiah Kamurari the loser of Jan.14th.2021 Bukanga north parliamentary polls.
The electoral Commission declared Nathan Byanyima the winner in the Bukanga North polls after he garnned 34229 votes beating his closet rival Kamurari’ Jeremiah who collected only 12067 votes.
Kamurari in protest to the results petitioned Mbarara high Court through his lawyers of Turinawe Kamba and co. Advocates requesting court to overturn Byanyima’s victory.
He claimed that at the time of nominations Nathan Byanyima’ presented documents in the names of Byanyima’ Nathan Jimlex while his national Identify card bears the names Byanyima’Nathan thus academic documents presented by the second respondent at the time of nominations do not belong to him.
However on Tuesday 17th.August, 2021 Byanyima’s lawyer of JByamukama and co. Advocates raised a criminal objection since the petitioner had filed the same law suit to electoral commission and High of which both dismissed it hence regarding as res judicata.
The High court also found out that Kamurari’s lawyer Of Turinawe Akamba and co. Advocates had no license and had even commissioned his affidavits which is unlawful.
In his ruling which was read by Mbarara high court deputy registrar Samuel Twakiire, the judge quashed Kamurari’s election petition on grounds that the matter had before been dismissed by the High court and the National electro commission and ordered him to pay court costs.
Speaking to journalists after the court session, Kamurari’ Jeremiah called for calmness on the side of his supporters and vowed to appeal to the court of appeal.
