MBARARA: COURT DISMISSES WITH COSTS KURURAGIRE’S VOTE RECOUNT APPLICATION AGAINST TABARO

Mbarara magistrate court presided over by His worship Samuel Twakiire yesterday dismissed with costs a vote recount application filed by Kururagire Hygiene Twongirwe who lost to Didas Tabaro in the just concluded LCV chairperson polls.
According to the results that were released by the Mbarara district Returning Officer Betty Komugyeteko, Didas Tabaro was who scored 20583 votes defeated his closest rival Kururagire Twongirwe Hygiene with a difference of 2019 votes.
Kururagire through his Lawyers of Arinaitwe Aruho and Company Advocates however petitioned the magistrate court in Mbarara challenging the results tallied on the night of 25th.Jan.2021 by electoral commission where Didas Tabaro emerged the winner.
Nuwamanya Justus the lead counsel representing Kururagire alleged that from the evidence on ground, at some polling stations in Kashari North, the agents of the applicant were chased away.
He added that there was no factual counting of the votes cast adding that some Declaration forms were not signed by Kururagire’s agents.
“Musinguzi Deus a supporter of the applicant gives evidence that he was beaten by the supporters of the second respondent,” Lawyer Nuwamanya noted.
Meanwhile, Lydia Ahimbisibwe a lawyer representing both electoral commission and Didas Tabaro noted that the application was null and void since most of the evidence brought to court was just hearsay and baseless
However, Magistrate Samuel Twakire in his 40 minutes ruling, further observed that no good cause has been shown and there was insufficient and irrelevant evidence adduced, mostly hearsay thus dismissing with costs the application for a vote recount for the Mbarara district.
