MBARARA HIGH COURT QUASHES BWAHIKA’S PETITION TO BLOCK MUTUNGI FROM BEING NOMINATED

High Court in Mbarara has today quashed an injunction request filed by Ritah Bwahika against Bonny Kiconco Mutungi stopping her from being Nominated as the NRM flag bearer for Mbarara city woman MP
Ritah Bwahika through her lawyer Bainomugisha Charles petitioned the high Court Last week seeking a temporary injunction to block the nomination of her opponent until the main case is disposed of.
Bwahika requested court to block Mutungi’s nomination claiming that decision by the NRM elections disputes tribunal to declare her as winner was biased thus should be dismissed.
The Mbarara city NRM registrar, Ssebuma Kaweesi last month had declared that Ritah Bwahika had won the election with 14,795 votes followed by her rival Bonny Kiconco Mutungi who had 12567 votes
But the NRM elections tribunal chaired by Enock Batara over turned Ritah Bwahika’s victory hence declaring Bonny Kiconco Mutungi as the duly elected Woman MP flag bearer Mbarara city
The tribunal’s decision forced Bwahika to file an application seeking a temporary injunction and judicial review of who should hold the NRM flag for Mbarara city.
The deputy registrar, Samuel Twakire has quashed the application with costs on grounds that the procedures used by the Counsel Bainomugisha Charles a lawyer representing Ritah Bwahika were not proper and so he can challenge it in the court of Appeal.
Relatedly, the high Court in Mbarara presided over by Judge Tadeo Asiimwe has set tomorrow the 13th of October,2020 at exactly 02:00 PM to give it’s verdict on the main suit where Anna Kansiime is seeking court to block the nomination of Molly Asimwe as the Rwampara woman MP NRM flag bearer.
