NALONGO ESTATES LTD SUES KCCA, UNRA OVER BREACH OF CONTRACT

Nalongo Estates Limited has dragged to the high court two-government agencies, accusing them of breaching a contract, leaving Kampala flyover project at stake.

Nalongo Estates filed the case against Kampala Capital City Authority (KCCA) and Uganda National Roads Authority (UNRA) in the Land Division of the High Court in Kampala on November 12, 2020.

Through Muwema and Company Advocates, Nalongo Estates allege that the government agencies used the remaining land, which has been excluded from the flyover project.

Nalongo Estates contend that for the last 14 years, it has been the sitting occupant/lease of the properties at Kitante Road (Yusuf Lule Road) and Jinja road at Centenary Park.

The managing director of the estate, Sarah Kizito, said subsequent to the initiation of the Kampala flyover project by Government, Nalongo Estates and KCCA, executed a memorandum of understanding (MoU) on March 19, 2020.

This, according to Kizito, was to enable the seamless implementation of the said project, since Nalongo Estates properties were going to be affected by the project.

“The MoU recognised that KCCA had approved/accepted Nalongo Estates application for renewal of the leases of the property in its meeting held on May 17, 2017.

In the meeting, it was agreed that KCCA shall immediately grant to Nalongo Estates the lease and effect the registration of the extension of the sub-lease in respect of land comprised in plot 5 park, which is not affected by government projects.

According to court documents, KCCA had agreed to handover to Nalongo Estates the certificate of title for the said land before commencement of the implementation of the government projects.

Documents further reveal that KCCA was supposed to effect the registration of the extension of the sub-lease over plot 96A -100A Kitante Road for purposes of enabling Nalongo Estates to replace the affected building and other developments, which will be demolished to pave way for the flyover.

Kizito says she will cause UNRA, the implementing agency for the project to compensate Nalongo Estates due to her developments on the land.

“Upon execution of the lease offers, KCCA shall process and grant lease offers and lease agreements to Nalongo Estates and submit to the Commissioner Land Registration and issue certificates of titles for Kitante land on such terms and conditions agreed by the parties,” she contends.
