THREE SENT TO ROT IN PRISON FOR 32 YEARS OVER MURDER IN RUKUNGIRI

Rukungiri High court presided over by the Justice Moses Kazibwe Kawumi on Tuesday 29th may2019 sentenced three people to 32 years imprisonment each after found guilty of murdering their friend.
Prosecution led by state attorney, David Katungye told court that the accused persons, Vian Tumuhimbise, Savio Natukunda and Alex Tukamuhebwa on 1st May 2017 at Rwanengo cell, Nyabiteete parish in Bugangari sub county Rukungiri district murdered, Gilbert Ruhangarinda, 32, after failing to agree with him on how to share the money they had sold from the coffee which they had stolen in the same village.
“The accused people were all friends of the victim as they have been working together for long but after the victim disagreed with them they knew he would tell the public how they have been terrorizing the resident by stealing their property and decided to end his life,” Katungyi said.
Prosecution further told the court that the convicts were supposed to get maximum sentence as the penal code act stipulates which is death sentence but asked the court at least to give them 50 years in prisons so that the parents and relatives of the person whom they killed would be free of trauma which they got.
“The accused used a rope to tie the victim in neck, legs and arms before they lynch and dumped him on the road side which traumatized who ever saw the body,” he said.
Defense lawyer, Jonathan Bwagi pleaded with court to give the convicts simple punishment since they look still young they would reform and know how to stay in society.
The convicts have been on remand for two years.
Alex Tukamuhabwe the accused number three told court that he has eight children and two young wives who need care from him very much and that the fact that he was not with other convicts in killing only that he helped them to carry the body to dump asked the court to forgive him and go to look after his children.
Justice Moses Kazibwe Kawumi while delivering the judgment said that he has considered the time they have spent on remand and the fact that they don’t have on record another criminal offence therefore, he sentenced each 32 years in prison.
Meanwhile, the same court also sentenced a 52 years old man Erikard Magezi positive with HIV to 20 years in prison for defiling his 8 years old daughter.
