KABALE: FDC’S TWEYAMBE WINS CASE AGAINST ATTORNEY GENERAL OVER ILLEGAL DISMISSAL

High court in Kabale yesterday ruled in favor of Darius Tweyambe in a case he filed against the Attorney General over wrongful dismissal from public service.
Tweyambe sued the government for illegal dismissal without following the rules of natural justice..
Tweyambe, a member of the Forum for Democratic Change Party, was arrested on treason, murder and illegal possession of guns in 2004 and incarcerated in Kigo, Luzira upper, Bushenyi Prison. He was then a teacher on payroll at Kinyasano Girls High School.
When he was released in 2007, he demanded to be reinstated on the pay roll since courts had cleared him. However, government interdicted him retrospectively on 11/4/2008 until 2014 when he was completely deleted from the payroll before the conclusion of the case.
However the permanent secretary ministry of Education and the IGG, Irene Mulyagonja cleared him 2014, the Town Clerk Rukungiri Municipality Otim Andrew Kibwoota challenged this decision. This made him to rush to court for Judicial review.
Justice Moses Kawumi yesterday ruled that decision reached by the education service commission contravened the law and ordered that Tweyambe be reinstated and his arrears be paid. He also awarded him damages and costs of the suit.
