OTADA’S CASE DISMISSED, AMIN’S NOMINATION STANDS

Masindi high court has today dismissed Hon.Sam Awori Otada’s case in which he was challenging the nomination of Tampoo Iddi Amin; as a candidate in the NRM primaries.
Last week, Otada through his lawyer Asuman Nyonyintono of Wagabaza and co. advocates rushed to Masindi court to challenge the nomination of Tampoo Iddi Amin, claiming that he was wrongly nominated by the NRM electoral commission since grounds which were based on to nullify Tampoo’s election as MP Kibanda north were still standing.
Tampoo’s election was canceled by the court of appeal in May this year after it discovered that there was discrepancy in his names on his academic transcripts and those in the voters register.
Today Masindi high court which was presided over by the Masindi resident judge Albert Rugadya Atwooki dismissed the application on grounds that it was not supported by evidence.
Delivering the ruling, Rugadya also noted that Otada’s affidavits had a lot of issues which needed corrections and a lot of time.
Rugadya dismissed Otada’s application with costs but told Otada that he still had some chance to settle the issues and file a fresh application.
Commenting on the judgment, Otada conceded that his affidavits had issues noting that he was going to file afresh application by the end of this week.
Otada added that his lawyers also erroneously put the attorney General and not the NRM in the affidavit which was a big mistake on his side.
Otada also said that something are being done to frustrate him such that he can leave his party saying that is the founder of NRM and no one will force him leave it.
He added that the nominations which are scheduled for 20th July 2017 by the electoral commission should go on but the NRM must present a proper candidate noting that they again present Tampoo Iddi Amin as a candidate another by- election in Kibanda North County should be predicted.
He also explained that the recent primary election was conducted in defiance of the court order which makes the primary elections of the NRM null and void.
