KABALE: COURT DISMISSES RUKUNGIRI WOMAN MP ELECTION PETITION

High Court in Kabale has dismissed an election petition filed against Rukungiri Woman MP Betty Bamukwatsa Muzanira (FDC) by her former contender.
Bamukwatsa’s election victory on 31st May 2018 in the woman MP by-election was challenged by the National Resistance Movement (NRM) candidate Winfred Matsiko, who alleged that the process was marred by voter bribery, voter intimidation, and failure by the Electoral Commission to organize the election in a free and fair manner.
Justice Moses Kawumi Kazibwe, the Kabale resident judge, while delivering his judgment today, said that Matsiko failed to produce substantial evidence pinning Muzanira or showing how the electoral body failed on its part to conduct a free and fair election.
“The petitioner has failed to prove all the allegations she made against the first and second respondent respectively. The petition failed in its entirety and it’s dismissed with costs to the first and second respondent respectively,” ruled Justice Kazibwe.
Matsiko petitioned the High Court on 6th July 2018 seeking nullification of the declared results where Betty Muzanira was announced the winner.
She also asked for an order for fresh election claiming the process was marred with several irregularities and malpractices.
The ruling was delivered at the court in the absence of the petitioner, Mrs Matsiko.
Muzanira who was at the court with her lawyers, said afterwards that all her victory in the elections as well in the courts of law is due to God whom she trusts in.
The MP also thanked the judiciary for doing a good work in the shortest time and delivering justice.
