Bushenyi High Court on Wednesday lifted an interim injunction that had suspended the operations of the Bushenyi District Executive Committee and the District Service Commission, allowing the two bodies to resume their official duties.
The ruling was delivered by the Deputy Registrar of the Bushenyi High Court, His Worship Andrew Kabombo, who dismissed an application for judicial review filed by five district councillors.
The court found that the applicants had failed to provide sufficient substantive evidence to justify continuing the injunction, noting that the order was hindering the district’s ability to deliver essential services to the public.
The application had been filed by councilors; Douglas Mucunguzi, David Kakama, Anthony Asingwiire Katwarana, Denis Nayebare, and Allan Arinda. They had sought a judicial review of the conduct of the Bushenyi District Council and successfully obtained an interim injunction that temporarily halted the activities of the District Executive Committee and the District Service Commission pending the determination of their application.
In his ruling, Kabombo held that there was no adequate basis to continue denying the district an opportunity to execute its statutory mandate while the substantive case is yet to be heard.
Following the court’s decision, the Bushenyi District Executive Committee and the District Service Commission are expected to immediately resume their operations as the district awaits the hearing and determination of the main judicial review suit challenging the actions of the District
